PRIMAL POWER COACHING TERMS AND CONDITIONS

 

The purpose of this document is to clearly outline the nature and purpose of the service and responsibilities of both the client and the coach (Val Chembartseva, founder and head trainer at Primal Power Coaching).

 

Description of coaching: coaching is a partnership (defined as an alliance, not a legal business partnership) between the coach and client the purpose of which is to improve the client’s physical fitness, wellbeing and work towards a mutually established goal. The coach is there to provide an individualised exercise programme along with a suitable nutrition strategy, as well as serving as a point of accountability and guidance. This also includes the management of diet, stress, and overall health. It is the client’s responsibility to implement the non-medical advice given by the coach.

1. Terms of service

1.1 ONLINE COACHING

1.1.A The client receives access to a tailored, individualised exercise programme complete with appropriate warm-up drills, stretches and cool down drills which is reviewed weekly. The programme contains a workout tracker, video demonstrations and tutorials of key protocols prescribed by the coach as well as detailed instructions on how to perform them. In addition to the exercise programme, the coach also provides a lifestyle tracker and nutritional support which is updated on a weekly basis. It is up to the client to be as transparent and honest as possible when providing feedback and information about their progress, as well as recording their data on the tracker provided.

1.1.B All coaching is subscription-based, with a set price charged within the first week of each month and a set number of monthly hours allocated to the client. 

1.1.C Online coaching hours are delivered exclusively through virtual communication between coach and client, including but not limited to: video calls, audio calls, weekly check-in calls, video exercise technique feedback and online programme management. It is the client’s responsibility to schedule and arrange their allocated number of monthly calls, and ANY UNSCHEDULED CALLS DO NOT CARRY OVER INTO THE NEXT MONTH AND WILL BE CLASSED AS ‘LOST’ IF NOT USED UP.

Note: if the client is available in person, the time spent with the coach can be in person also.

1.1.D Between the occurrence of the said calls, the client is welcome to contact the coach through message and email to address any issues that may arise. The coach is obliged to reply within the period of 24 hours unless they declare themselves unavailable (e.g. due to illness, holiday, or other).

 

1.2 IN-PERSON COACHING

1.2.A When starting a package subscription, the client receives access to a tailored, individualised exercise programme complete with appropriate warm-up drills, stretches and cool down drills which is reviewed weekly. The programme contains a workout tracker, video demonstrations and tutorials of key protocols prescribed by the coach as well as detailed instructions on how to perform them. In addition to the exercise programme, the coach also provides a lifestyle tracker and nutritional support which is updated on a weekly basis. It is up to the client to be as transparent and honest as possible when providing feedback and information about their progress, as well as recording their data on the tracker provided.

1.2.B All coaching is subscription-based, with a set price charged within the first week of each month and a set number of monthly hours allocated to the client. Should the client not wish to purchase a subscription and opt for ‘one-off’ training sessions on an ad-hoc basis, they will not receive complete coaching in the form of a periodised programme, nutrition guidance and accountability support. The coach will deliver the most constructive session possible, but it will not be as part of a programme. The coach will also not be obliged to keep track of the client’s progress.

1.2.C Each in-person session is intended to last sixty minutes, including an appropriate, session-specific warm-up and cool down. Should the session overrun due to external circumstances (i.e. due to time spent waiting for equipment), the coach will do their best to guide the client through the session outside of the sixty-minute time slot.

1.2.D Physical contact may be required to achieve proper positioning and technique, and/or to assess the client’s response. If the client experiences physical or psychological discomfort at any point, it is their responsibility to inform the trainer immediately.

1.2.E Should the client be more than twenty minutes late to a session with or without informing the coach prior, the coach has the right to void the session without rescheduling, classifying it as ‘lost’.

1.2.F Depending on the chosen in-person personal training package, a client is entitled to a pre-set number of sessions within that billing month. It is preferable for the sessions to be scheduled on a regular, pre-agreed basis (for example, two session every week of the month), but generally these sessions can be scheduled at any time within the given month.

1.2.G It is the client’s responsibility to schedule and arrange their allocated number of sessions.

1.2.H Between sessions, the client is welcome to contact the coach through message and email to address any issues that may arise. The coach will do their best to reply within the period of 24 hours unless they declare themselves unavailable (e.g. due to illness, holiday, or other).

1.2.I The coach will do their best to provide a weekly review of the client’s progress in either audio or video format – this is a short assessment to ensure that the programme is on track and the client is not experiencing any difficulties or challenges and is referred to as a ‘check-in’.

1.2.J ANY UNSCHEDULED MONHTLY SESSIONS WILL NOT CARRY OVER INTO THE NEXT MONTH. IF ANY SESSIONS FROM THE CLIENT’S MONTHLY PACKAGE ARE NOT BOOKED AND COMPLETED, THEY WILL BE CLASSED AS ‘LOST’, AND NO REFUND OR REARRANGEEMENT WILL BE ISSUED. 

1.2.K Should there be any circumstances from the coach’s side (sickness, emergencies, etc.) preventing the successful delivery of the client’s monthly sessions, the client is entitled to a refund.  

1.2.L Should the client wish to, they are able to purchase additional hourly personal training sessions at the standard ‘one-off’ price which will not be part of their monthly subscription fee.

1.2.M If you’re an existing client training on a session-by-session basis, you do not have to go through the movement assessment and deposit process, and instead are able to commence the subscription straight away.

 

2. Payments and fees

2.1 All coaching (programme periodisation, nutritional support, weekly check-ins, accountability support and workout tracking) is a subscription-based service for which the client will be charged for on a monthly basis.

2.1.A If the client is training on an ad-hoc basis, they will be invoiced prior to the session occurring. The payment must be made prior to the session occurring, otherwise the coach is under no obligation to deliver the session and holds the right to cancel the appointment.

2.2 The client on-boarding process starts with a free, thirty-minute no-obligation consultation, and follows with a movement assessment appointment which also serves as a non-refundable programme design deposit

2.3 The client is entitled to a 7-day cool-off period after signing the contract during which they retain the right to terminate the agreement without financial repercussions.

2.4 Should the client terminate the agreement after the cool-off period and before the completion of the first 8 weeks of the programme, half of the total 8-week payment will be retained. This is enforced to encourage adherence and accountability, as well as income protection.

2.5 The minimum term of commitment is two calendar months, or eight weeks as this is generally the minimum amount of time required to see results from a regiment of physical exercise and nutritional manipulation.

2.7 Pricing is standard and will not be negotiated unless there is a promotional sale, seasonal discounts or a gesture of goodwill as specified by the coach. Primal Power Coaching reserves the right to change coaching fees at any given time, with the change enforced at the end of the client's billing cycle. Any changes in fees will be given an advance notice. 

2.8 ‘STRIPE’ is a 3rd party payment management system used to automate payments. By signing this agreement, you consent to your credentials and payment information to be stored on this platform to allow the subscription to take place. Should the coaching agreement be terminated, this data remains on the platform for the period of 3 years. The client has the right to request for this information to be removed.

2.9 ‘PRIMAL POWER COACHING’ has the right to authorise any outstanding charges to existing credit cards on the client’s file. Should such a charge not be successful, the coaching agreement is dispelled, and the coach is under no obligations to deliver services.  

 

3. Cancellations and terminations

3.1 The client is entitled to a 7-day ‘cool off’ period after the signing of the contract, during which they are entitled to terminate the agreement without further charges. Should the client terminate the agreement after the cool-off period and before the completion of the first 8 weeks of the programme, half of the total 8-week payment will be retained.

3.2 The client is subject to give one month notice prior to terminating their coaching subscription without being charged for the next month.

3.3 Primal Power operates on a scheduled hourly appointment basis for personal training sessions. Therefore, when cancelling or rescheduling an appointment, the client is required to provide MORE than 12 hours’ notice for the session to be rescheduled. However, if the client cancels a session LESS than 12 hours prior to the scheduled time, the session will be counted as ‘lost’.

3.4 Emergency cancellations will be treated at the discretion of the coach.

3.5 Should the client suffer an injury or find themselves in circumstances when they are unable to carry on the subscription, all non-occurred sessions on their subscription will be refunded and cancelled.

 

 

4. Liability

4.1 By signing this agreement, the client affirmatively states that they have disclosed any and all known medical or genetic conditions, medications they use, and any significant personal or family medical history which may affect their fitness programming.

4.2 An exercise protocol will yield best results if followed alongside an appropriate nutrition strategy and adherence to not only the prescribed exercise programme, but general guidelines in regard to lifestyle and well-being such as overall physical activity (daily step count and out of the gym cardiovascular activities), balanced diet and suitable recovery protocols.

4.3 The coach is not a medical doctor or physician and does not diagnose disease, therefore all guidance provided is advisory only and is to be followed at the client’s discretion.

4.4 There are chances that during a session, an adverse reaction to exercise may occur such as dizziness or fainting. These might be due to an abnormal increase in blood pressure, poor pre-exercise nutrition, or any other factors. In rare instances, it may lead to a heart attack or stroke which may be a cause of death.

4.5 There is a possibility of injury occurring during participation of the exercise programs which may involve joints, ligaments, muscles, and tendons. It is the client’s responsibility to communicate with the coach during exercising if experiencing discomfort or pain.

4.6 Any recommendations that the client follows for changes in diet, exercise and lifestyle including but not limited to the use of food supplements, are followed entirely by their own discretion and are advisory only.

5. Privacy

5.1 Primal Power is committed to respecting the privacy and comfort of all clients; therefore the coach is obliged to gain consent before recording footage from sessions for promotional purposes.

5.2 Any client footage recorded and requested will be used in good will and is intended to allow the coach to gain a better physiological understanding of the client’s body. It will not be shared or disclosed without the client’s permission.

5.3 All personal information collected is kept confidential and contributes towards the improvement of client wellbeing and programme design.

5.4 By signing this agreement, you automatically opt into any weekly / monthly communication from the coach.
